Terms of Service

Aha Math is a guided, conversational math-tutoring service intended for children under the direction of a parent or legal guardian. The Service is an educational aid that helps a learner think through math problems. It is not a substitute for a qualified teacher, licensed tutor, school curriculum, or professional educational assessment. Answers are generated by an AI model and may occasionally be incorrect or incomplete.

• Only a parent or legal guardian may create an account. By creating an account you represent that you are at least 18 years old and are the parent or guardian of each learner you add.
• You are responsible for keeping your login credentials confidential and for all activity under your account, including your child's use of the Service.
• You may add, edit, or remove learners at any time from your family dashboard.

You agree not to, and not to allow any learner or third party to:

• Use the Service for anything other than personal, non-commercial tutoring.
• Attempt to reverse-engineer, scrape, or resell the Service.
• Upload content that is unlawful, hateful, harassing, sexually explicit, or that violates another person's rights.
• Attempt to bypass safety guardrails, extract system prompts, or use the tutor to produce answers for standardized-test cheating or academic misconduct.
• Interfere with the security or integrity of the Service.

We may suspend or terminate accounts that violate these rules.

• Free plan. The Service is available at no cost with a limit of 1 new problems per learner per day.
• Unlimited plan. $6.99 per month, billed by our payment processor. Removes the daily cap for every learner in your family.
• Free trial. New subscribers may receive a 7-day free trial. If you do not cancel before the trial ends, your subscription will renew and you will be charged the subscription fee.
• Automatic renewal. Subscriptions renew automatically each billing period until cancelled.
• Cancellation. You may cancel at any time through the billing portal available from your dashboard. Cancellation stops future charges; you'll keep access through the end of the paid period. Except where required by law, fees already paid are non-refundable.
• Price and feature changes. We may change subscription pricing or features with reasonable prior notice. Changes take effect at the start of your next billing period.

The Service, including software, design, and coach prompts, is owned by us and protected by law. You retain any rights you have in content you or your learner submit (such as photos of a worksheet). By submitting content, you grant us a limited license to process it solely to operate the Service.

Our Privacy Policy explains what information we collect and how we handle it, including our children's-privacy commitments.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY TUTORING RESPONSE IS ACCURATE, COMPLETE, OR APPROPRIATE FOR A PARTICULAR ASSIGNMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $50.

You may stop using the Service at any time by deleting your account. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (payment, disclaimers, limitation of liability, governing law) will do so.

These Terms are governed by the laws of the State of [GOVERNING_STATE], without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in [GOVERNING_STATE] for any dispute not subject to arbitration.

We may update these Terms from time to time. If changes are material we will provide reasonable prior notice by email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
